How to register a fertilizer or biostimulant in Texas
Texas registers commercial fertilizers through the Office of the Texas State Chemist, which administers the state's fertilizer control law. Whether a microbial input is regulated as a commercial fertilizer or another product class depends on its composition and label. Settle classification with OTSC before anything else.
The steps
- 01
Confirm classification with OTSC
Microbial and biostimulant-type products sit at the edge of the fertilizer definition. The state chemist's office determines how your product is regulated. Ask before you file, not after.
- 02
Register the firm and each brand
Firms register with OTSC, then register each product brand and label distributed in Texas.
- 03
Pass label review
Labels are reviewed against the controlling law. Texas is an AAPFCO member state, so accepted claim language for your organism is the reference point for what the label can say.
- 04
Report tonnage and renew
Registered firms file tonnage reports and renew registrations on OTSC's schedule. Fees and inspection charges are set by the agency. Check the current schedule.
Texas label expectations track the AAPFCO model bill, but registration decisions remain the state chemist's. A product accepted in one state can still be questioned in another.
Label review starts with what your organism is allowed to say.
Look up your organism’s verbatim AAPFCO-accepted claim statements before drafting the label. It’s the language reviews check against.

Does my California registration carry over to Texas?
No. Each US state registers independently. The dossier and claim language can be reused, but the filing, review, and fees are Texas's own.
Who decides if my product is a fertilizer in Texas?
The Office of the Texas State Chemist. Classification drives everything downstream, so confirm it with the agency first.
